    Terms of Use — CrossbordIA Version 2.7 — 9 October 2026 SIREN 103 738 084 — R.C.S. Paris Reserved for professionals — Exclusively B2B use

Preamble These Terms of Use (“Terms of Use”) govern access to and use of the CrossbordIA solution (website, application, API, modules and associated documentation), provided by CrossbordIA SAS, a simplified joint-stock company (SAS) with share capital of €1.00, whose registered office is located at 47 rue Vivienne, 75002 Paris, registered with the Paris Trade and Companies Register (R.C.S.) under number 103 738 084 (hereinafter “the Publisher”). CrossbordIA is a decision-support tool based on artificial intelligence (Google Gemini model), designed to assist professionals in the customs classification of goods. It does not under any circumstances constitute legal, tax or customs advice, nor a decision enforceable against an administration. Use of the Service implies full, complete and unreserved acceptance of these Terms of Use.

Must be read before any use CrossbordIA is a decision-support tool — it does not replace the expertise of a customs declarant or customs adviser. Any generated result must be verified by a competent professional before operational use. The Publisher expressly disclaims all liability for the consequences of a classification applied without human validation.

Article 1 — Definitions “Service”: the CrossbordIA SaaS solution, including the web interface, APIs, connectors and associated features. “Publisher”: CrossbordIA SAS, R.C.S. Paris 103 738 084, 47 rue Vivienne, 75002 Paris. “Customer”: any legal or natural person acting in a professional capacity who has accepted these Terms of Use. “User”: a natural person authorised by the Customer to use the Service. “Customer Content”: data, product descriptions, documents, files, labels and information provided by the Customer. “Results”: suggestions, scores, classifications or any output generated by the Service from Customer Content via the Google Gemini model. “Final Decision”: any operational decision taken by the Customer, in particular any customs declaration.

Article 2 — Scope — Exclusively B2B The Service is strictly reserved for professionals. By accessing the Service, the Customer declares that it: (i) is acting in the course of its professional activity, (ii) has the internal skills to assess, validate or reject the Results, and (iii) will not use the Service as the sole source of decision-making without qualified human supervision.

Article 2 bis — Free trial plan The Customer may open an account on the free trial plan, without a means of payment. This plan gives access to the features included in the Free plan as presented on the Pricing page, within the following limits: ten (10) credits allocated once only, not renewed; ten (10) items in the product database; two (2) Users; API calls limited to ten (10) per minute and one hundred (100) per day. The credits offered are subject to the validity and consumption rules set out in the Terms of Sale; they have no monetary value and are neither refundable, transferable nor convertible. To continue using the Service beyond these credits, the Customer takes out a subscription; credit top-ups are reserved for subscribers. The free plan is limited to a single use per company, assessed at the level of the legal entity (in particular by its SIREN number or its foreign company identifier), regardless of the number of Users, email addresses or accounts. Any manoeuvre aimed at obtaining the free plan more than once or at circumventing its limits is prohibited, in particular the creation of multiple accounts, the use of fictitious or disposable identities or email addresses, or the automation of sign-ups. In the event of an established breach, the Publisher may, after informing the Customer by email, refuse a sign-up, request proof of the company's identity, merge or close the accounts concerned and cancel the unused credits offered, without compensation. The data of closed accounts is processed in accordance with the Privacy Policy.

Article 3 — Description of the Service CrossbordIA is a decision-support tool that assists the Customer in the tariff classification of goods in the nomenclatures of the European Union (CN/TARIC), the United Kingdom (UK Global Tariff), the United States (HTS), Norway (Tolltariffen) and Canada (Customs Tariff). The Service applies the General Interpretative Rules (GIRs) in their order and cites the texts (section and chapter notes, explanatory notes) on which it relies. Where a fact necessary for classification is not established by the data provided, the Service does not presume it: it asks the Customer a question. The Service uses Google AI models (Gemini). All features are provided by way of assistance, with no obligation of result.

Article 3 bis — Answers, standing instructions and supporting document The answers given by the Customer to the Service's questions are facts declared under its sole responsibility. The Customer may save an answer as a standing instruction: it then applies as a declared fact to the items of its company (or of the designated shipper) that fall within the scope it has chosen. A standing instruction cannot impose any code; data declared on an item always prevails over it. The Customer may deactivate an instruction at any time, without effect on classifications already carried out. The customs supporting document produced by the Service sets out the texts cited and the facts relied upon, together with their source. It constitutes neither Binding Tariff Information nor a legal opinion.

Article 4 — Transparency — AI System (EU AI Act 2024/1689) The Customer is informed and acknowledges that the Service uses automated processing including probabilistic artificial intelligence components (Google Gemini). Accordingly: The Results may be inaccurate, incomplete, out of date or unsuited to a particular situation. The Service does not provide Binding Tariff Information (BTI) within the meaning of the customs regulations applicable in each destination jurisdiction (in particular the Union Customs Code and British, American, Norwegian and Canadian regulations). The data submitted may be processed by Google LLC on servers located outside the EU (transfers governed by the Standard Contractual Clauses). The Publisher does not guarantee that the Results will be accepted by the customs administrations.

⚠ AI warning — read carefully The classifications offered by CrossbordIA are proposals drawn up using probabilistic AI models, which may be erroneous, generated by Google Gemini. They may be erroneous even when they appear relevant. Direct use of a Result without human verification engages the sole liability of the Customer. In accordance with Regulation (EU) 2024/1689 (AI Act), the Customer is informed of the automated nature of the processing.

Article 5 — No warranty as to the Results The Publisher is bound by an obligation of means. The Publisher does not guarantee the accuracy, completeness, compliance or suitability of the Results. In particular, the Publisher does not guarantee that: the customs codes suggested are correct with regard to the nomenclature in force; the Results are consistent with the interpretation adopted by the competent customs authorities; the Results take account of rules of origin, trade measures, tariff suspensions or special measures; the Results are suited to the destination, end use or specific characteristics of the goods.

Article 6 — No advice The Service does not constitute the provision of legal, tax, customs or regulatory advice. The Results do not constitute a BTI, an administrative decision or a legal opinion engaging the liability of the Publisher.

Article 7 — Exclusions of liability — Customs classification To the extent permitted by law, the Publisher shall not be held liable for: any customs, tax or quasi-tax reassessment resulting from an erroneous or disputed classification; any penalty, fine, surcharge or administrative sanction; any delay, blocking, seizure, quarantine or destruction of goods; any commercial loss, loss of turnover, loss of margin or loss of opportunity; any reputational damage or commercial dispute resulting from an applied classification; any error resulting from incorrect or incomplete information provided by the Customer.

⚠ Disclaimer — Maximum scope The Publisher's liability cannot be engaged for the consequences of a customs classification where the Customer is unable to demonstrate that it complied with the human supervision obligation defined in Article 8. This exclusion applies even in the event of a failure or inaccuracy of the Google Gemini model used by the Service.

Article 8 — Mandatory human supervision — Responsibility for the Final Decision The Customer acknowledges that CrossbordIA is a decision-support tool and that the Final Decision rests exclusively with it. The Customer undertakes to: implement qualified human supervision before any operational use of the Results; never use a Result as the sole source of truth for drawing up a customs declaration; validate each Result with regard to the regulations in force and the actual characteristics of the goods; keep a documented record of its internal checks. The Final Decision on classification is the sole responsibility of the Customer, including where it relies on the Results of the Service.

Article 9 — Obligations relating to Customer Content Provide precise, complete and up-to-date descriptions (composition, use, characteristics, origin, etc.). Not transmit data that is inaccurate or liable to mislead the Service. Refrain from transmitting sensitive data that is not necessary for the operation of the Service. The Publisher shall not be held liable for an inaccurate Result resulting from insufficient or incorrect Customer Content.

Article 9 bis — Continuous improvement of the Service

    1. In order to improve the quality and regulatory compliance of the Results, the Publisher analyses the operation of the Service: consistency of the classifications of the same item across nomenclatures, questions asked and answers given, error reports, comparison with published administrative decisions, stability of the Results.
    2. These analyses are carried out by the Publisher in aggregated form or after removal of the elements making it possible to identify the Customer, its products or its partners. The resulting improvements take exclusively the form of general rules of the Service based on the applicable texts (General Interpretative Rules, section and chapter notes, explanatory notes, published decisions).
    3. A Customer's Customer Content, Results and answers are never disclosed to another Customer or used to classify another Customer's items. They are neither sold nor transferred. The Publisher does not use them to train an artificial intelligence model.
    4. With the prior and express consent of the Customer, the Publisher may use an anonymised example taken from its items as an internal test case for the Service.
    5. Any personal data concerned is processed in accordance with the Privacy Policy.

Article 10 — Regulatory compliance obligations The Customer is solely responsible for compliance with the applicable regulations (Union Customs Code, export control rules, VAT, product safety, etc.).

Article 11 — Availability — Maintenance The Service is provided “as is” and “as available” via the Lovable platform (Lovable Labs AB, Stockholm, Sweden). Interruptions may occur. The Publisher implements reasonable security measures but does not guarantee the complete absence of vulnerabilities.

Article 12 — Intellectual property The Service and its components remain the exclusive property of CrossbordIA SAS. The Publisher grants the Customer a non-exclusive, non-transferable licence, limited to the term of the contract, to access the Service for professional purposes.

Article 13 — Personal data The processing of personal data is governed by the CrossbordIA Privacy Policy, available on the Service. GDPR contact: contact@crossbordia.fr.

Article 14 — Amendments to the Terms of Use The Publisher may amend these Terms of Use with reasonable notice. Continued use of the Service after notification constitutes acceptance of the new terms.

Article 15 — Governing law — Jurisdiction The Terms of Use are governed by French law. Any dispute falls within the exclusive jurisdiction of the Paris Judicial Court. The parties undertake to attempt an amicable resolution within a period of 30 days before any legal action.
