    Description of the goods

An article to be used in connection with infusion systems consisting of: — three interconnected transparent plastic tubes, each approximately 5 cm long and approximately 1,5 mm in outer diameter, — a Y-connector, — a simple Luer Lock connector with a rotating nut and a protective cap, — two Luer Lock connectors with an integrated non-return valve, and — two slide clamps. The three tubes are connected to each other with the Y-connector. The single tube, forming the lower branch of the ‘Y’, is fitted with a Luer Lock connector with a rotating nut and a protective cap, while the two tubes at the upper end of the ‘Y’ are each equipped with a slide clamp and a Luer Lock connector with an integrated non-return valve. The product is approximately 15 cm long in total. The Luer Lock connectors are used to connect the article to other tubes and/or devices (e.g. syringes) in a manner which prevents leakage. The article is designed for single use in healthcare facilities, home care, outpatient care and medical transport (e.g. in ambulances) in connection with infusion systems for administering liquids. For this purpose, the tube at the lower branch of the ‘Y’ is connected to the patient access side of the infusion system by means of a Luer Lock connector. Since there are two tubes, each with a Luer Lock connector at the upper end of the ‘Y’ (inflow), several doses of infusion can be administered simultaneously when the product is used, without having to touch or change the patient access side of the infusion system. The non-return valves form a physical barrier (closed system) and prevent microbial contamination. The inflow through the tubes can be regulated by the slide clamps attached to the tubes at the top of the ‘Y’. The article is presented in a sterile, single packaging. (See image) (*1)

    Reasons

Classification is determined by general rules 1, 3(b) and 6 for the interpretation of the Combined Nomenclature, Note 8 to Chapter 39 and by the wording of CN codes 3917 and 3917 33 00. Despite the fact that the article is presented in sterile packs and used for infusion systems, based on its objective characteristics, it cannot be identified as used solely or principally with such systems. Consequently, classification under heading 9018 as a part of a medical instrument within the meaning of Note 2 to Chapter 90 is excluded. The article is composite goods consisting of different components, namely (a) interconnected plastic tubes combined with plastic connectors, (b) clamps and (c) valves. The article incorporates more than accessory features to the valves (see also the Harmonized System Explanatory Notes (HSEN) to heading 8481, seventh paragraph). The interconnected plastic tubes with connectors play the essential role in relation to the use of the article, which is to administer liquids. It is therefore this component which gives the whole its essential character and it is to be classified according to that component. Consequently, classification under heading 8481 as a valve or similar appliance is excluded. As the plastic tubes are combined with plastic connectors, they shall be considered as plastic tubes with fittings. Given its objective characteristics and properties, the interconnected plastic tubes with connectors meets the terms of heading 3917 and fulfils the requirements of Note 8 to Chapter 39 (see also the HSEN, General to Chapter 39 and to heading 3917). It is therefore to be classifed under CN code 3917 33 00 as other tubes of plastics, not reinforced or otherwise combined with other materials, with fittings.

    Description of the goods

Galvanised threaded rods of steel other than stainless steel, with a metric thread along their entire length, without a head or recess, with a tensile strength of less than 800 MPa, in different lengths (between 1 000 and 3 000 mm) and diameters (between 4 and 36 mm). They are presented without nuts, washers or similar elements. The articles are used for joining, suspending or fixing a wide range of equipment and components. See images. (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 1 (d) to Chapter 72 and by the wording of CN codes 7318, 7318 15 and 7318 15 42. Since the article is threaded and used to assemble or fasten goods so that they can be readily disassembled without damage (see also the Harmonised System Explanatory Notes (HSEN) to heading 7318 (A), first paragraph), it has the objective characteristics of an article of subheading 7318 15 (screw studding; see also the HSEN to heading 7318 (A), third paragraph). Consequently, classification under CN code 7318 19 00 as other threaded articles is excluded. The articles are therefore to be classified under CN code7318 15 42 as other screws and bolts without heads, of steel other than stainless steel, with a tensile strength of less than 800 MPa.

    Commission Implementing Regulation (EU) 2026/360

    Of 10 February 2026 — CELEX 32026R0360

    CN code assigned:2106 90 98

    Description of the goods

Liquid sourdough starter made from whole grain rye flour in retail packaging of 150 g. It consists of: — Water, — fermented whole grain rye flour (44 %), — lactic acid bacteria, — yeasts, — fermentation products (lactic acid, acetic acid, ethanol, volatile organic compounds, etc.), — stabilizer (xanthan gum). It is intended to be mixed with flour, water, yeast and other ingredients to obtain a dough for the production of bakers’ wares.

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 2106, 2106 90 and 2106 90 98. Classification under heading 1901 as a food preparation of flour is excluded, because the essential character of the preparation is provided by the fermenting micro-organisms (lactic acid bacteria and yeasts), and the fermentation products (lactic acid, acetic acid, ethanol, volatile organic compounds, etc.). The flour plays a secondary role as a source of nutrients and as a carrier. Heading 1901 covers only food preparations with a basis of flour which derive their essential character from such material (see also the Harmonized System Explanatory Notes (HSEN) to heading 1901, point (II), first paragraph). Classification under heading 2102 as a yeast is also excluded, as this product contains micro-organisms other than yeast. Classification under heading 3002 as a culture of micro-organisms is also excluded, as this product does not constitute pure cultures of micro-organisms in the sense of heading 3002. The product is a complex food preparation based on several components (in addition to the lactic acid bacteria and yeast it contains also flour, fermentation products and a stabilizer) used in the making of food products (see also the HSEN to heading 2106, point (B)). Consequently, the product is to be classified under CN code 2106 90 98 as other food preparations not elsewhere specified or included.

    Commission Implementing Regulation (EU) 2026/333

    Of 5 February 2026 — CELEX 32026R0333

    CN code assigned:6307 90 98

    Description of the goods

A universal size article, measuring approximately 26 cm in length, consisting of two anatomically shaped, rigid plastic side-shells that are covering the ankle joint and part of the calf. A removeable padding consisting of a soft cellular foam covered with woven textile fabrics is attached to the inside of each of the shells by means of a vertical Velcro-type strip. The side shells are connected to each other in the heel area of the sole of the foot via a bridge made of a textile fabric. The length of the bridge is adjustable. The article is attached to the leg and tightened with two inelastic Velcro-type straps that are situated at the height of the calf. There is no means to tighten the article at the height of the ankle. The article is intended to stabilize the ankle joint to prevent, for example, sideways twisting. At importation it is presented to be worn inside a shoe and to be used as an ankle bandage in the case of damage to the ankle joint and/or ligaments. (See image) (*1)

    Reasons

Classification is determined by general rules 1, 3(c) and 6 for the interpretation of the Combined Nomenclature, Note 7(d) to Section XI and by the wording of CN codes 6307, 6307 90 and 6307 90 98. Classification under CN code 9021 10 10 as orthopaedic appliances is excluded, because the article cannot be adjusted to the needs of a specific user. Because the article is a universal size one and the two side-shells are rigid and have a universal anatomic shape, it is neither adjusted nor adjustable to the shape of the specific user’s ankle. Moreover, the article can be tightened solely at the height of the calf, with no means for adjustment through tightening at the ankle joint. Consequently, the article cannot be adjusted to a patient’s specific handicap within the meaning of the Court of Justice’s judgment of 7 November 2002, Lohmann and Medi Bayreuth, Joined Cases C-260/00 to C-263/00, ECLI:EU:C:2002:637 (see paragraphs 38, 41, 42 and 45). Moreover, the non-adjustability to the specific shape of the user’s ankle makes the article unable to completely, and under all circumstances, prevent specific undesired movements (for example, the sideways tilting) of the ankle joint in order to exclude further injuries (Note 6 to Chapter 90), as required for orthopaedic appliances of heading 9021, according to the second paragraph of Additional note 2 to Chapter 90. Classification under CN code 9021 10 90 as splints and other fracture appliances is also excluded, because the article cannot immobilise a fractured ankle joint for the reasons mentioned above (see also the Harmonised System Explanatory Notes to heading 9021, (II) Splints and Other Fracture Appliances, first paragraph). Consequently, the article is to be classified according to its constituent material. The article is a composite good consisting of different materials (textile and plastics) within the meaning of general rule 3(b) for the interpretation of the Combined Nomenclature. As far as the desired effect is concerned, the plastic shells as well as the textile straps are equally important. Consequently, both materials are equally essential within the meaning of general rule 3(b) for the interpretation of the Combined Nomenclature and the article is to be classified under the heading which occurs last in numerical order among those which equally merit consideration (headings 3926 and 6307) within the meaning of general rule 3(c) for the interpretation of the Combined Nomenclature. Therefore, the article is to be classified under CN code 6307 90 98 as other made-up articles of any textile fabric.

    Description of the goods

A specially shaped bracket, made of heat-resistant, stainless-steel wire, used as a retainer for the heating element of an electric grill. The heat-resistant wire can resist heat up to 800 °C. The article has specific dimensions to fit in a specific type of grill apparatus and has bent ends, so that the bracket can be fixed in a hole at the bottom of the grill housing (bowl). Its ends are bent to allow secured fixing of the bracket in a designated hole at the base of the grill. The retainer is designed to keep the heating element in the appropriate position, by supporting its weight and by firmly holding it in place. The article does not perform any additional function (e.g. heating). See images (*1).

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 7326 and 7326 20 00. The article is an important component of the electric grill. It is intended to support and hold the heating element in place, thereby ensuring consistent and even heat distribution across the cooking surface/grate, reducing the risk of electrical hazards and extending the lifespan of both the heating element and the grill. Nevertheless, based on its objective characteristics, the article is not identifiable as being a part suitable for use solely or principally with electrothermic appliances of heading 8516. Classification under heading 8516, as a part of the electric grill is therefore excluded. (See also the judgment of the Court of Justice of the European Union of 19 July 2012 in Case C-336/11, Rohm & Haas Electronic Materials CMP Europe GmbH and Others, ECLI:EU:C:2012:500, paragraphs 34 and 35.) Consequently, the steel bracket is to be classified according to its constituent material, under heading 7326, as other article of iron or steel. The product is therefore to be classified under CN code 7326 20 00, as an article of iron or steel wire.

    Description of the goods

Bathing unit, so-called swim spa, for outdoor use, made of ABS plastic, measuring approximately 420 × 225 × 127 cm. The article has a net weight of 800 kg, and a volume of 5 000 liters. The swim spa is equipped with: — massage nozzles, — counterflow nozzles with powerful jets, — massage pumps, — a heating system, — a filtering system, — a circulation pump, — an air regulator, — an ozone wash chamber, — LED lighting, — a handrail and neck pad, — full insulation and wood cladding. The article has a graduated basin, including 6 places for massage with a total of 36 nozzles (1 place with 12 nozzles, 1 place with 8 nozzles, 1 place with 6 nozzles, 2 places with 4 nozzles and 1 place with 2 nozzles). It also provides a swimming area for one person of approximately 3 meters in length, with 4 nozzles (with powerful jets, for counter-current/‘in place’ swimming) It is designed to be used as a hydromassage apparatus and as a swimming pool for swimming and other water-based exercise. (See image) (*1)

    Reasons

Classification is determined by general rules 1, 3(c) and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 9506, 9506 99 and 9506 99 90. The product is considered composite goods within the meaning of general rule 3(b), consisting of a hydromassage apparatus of heading 9019 and a swimming/paddling pool of heading 9506. The product shall be classified as if it consisted of the component which gives it its essential character. As the article is specifically designed to function simultaneously as a hydromassage apparatus and as a swimming pool, the component giving the essential character to the product cannot be determined. Both the special nozzles and pumps necessary to perform the hydromassage/spa therapy and the pool equipped with the special nozzles with powerful jets, for the counter-current swimming or other water-based exercise, are of equal importance. Consequently, the product is to be classified under the heading that occurs last in numerical order among those which equally merit consideration, that is under heading 9506, as a swimming pool. The product is therefore to be classified under CN code 9506 99 90, as a swimming pool.

    Description of the goods

Unassembled product comprising profiles (made of aluminium alloy and anodised) and fasteners (made of plastics), for use in the assembly of a voting booth, consisting of: — 6 hollow ‘vertical’ profiles, cut to length, of uniform cross-section along their whole length, with holes and fitted with fasteners, — 12 hollow ‘horizontal’ profiles, cut to length, of uniform cross-section along their whole length, with holes and fitted with fasteners. The voting booth is assembled on site. Depending on its adjustment, the assembled product can be placed on the ground or on a table and it can be carried to wherever it is needed. The ‘walls’ (plates designed to be mounted between the profiles) are not included at importation. The product, once assembled and fitted with the walls, is designed to provide a temporary cover to ensure voter secrecy.

    Reasons

Classification is determined by General Rules 1, 2(a), and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 7616, 7616 99 and 7616 99 90. The product consists of various components, presented unassembled. It comprises not only aluminium profiles but also fasteners, all intended to be used together to assemble a specific article, namely, the frame of a voting booth. Classification under heading 7604 as aluminium profiles is therefore excluded. Classification under heading 9403 as other furniture and parts thereof is also excluded. The assembled article is not used, mainly with a utilitarian purpose, to equip private dwellings, hotels, theatres, cinemas, offices, churches, schools, cafés, restaurants, laboratories, hospitals, dentists’ surgeries, etc. It is (once assembled and fitted with the walls) designed to provide a temporary cover during voting. In addition, the assembled article can be placed either on the floor or on other pieces of furniture (such as tables). However, the term ‘furniture’ does not apply to articles used as furniture but designed for placing on other furniture or shelves, or for hanging on walls or from the ceiling. (See also the Harmonized System Explanatory Notes to Chapter 94, General, item (B) and exclusion paragraph to this item.) The article is therefore to be classified under CN code 7616 99 90 as other articles of aluminium.

    Commission Implementing Regulation (EU) 2025/1556

    Of 22 July 2025 — CELEX 32025R1556

    CN code assigned:5911 90 99

    Description of the goods

Disposable article, measuring approximately 28 cm (length) × 12 cm (width), made-up of a circular densely crocheted textile fabric of man-made fibres. On one end, the article is closed with a seam. On the other end, the article has an opening with a highly elasticated hemmed edge of approximately 3 cm width. At importation, the article is presented as a pre-filter; a sort of filter lining for skimmer baskets (baskets of plastics having a net-like structure; the baskets are inserted into the openings that drain a swimming pool in order to catch leaves and dirt before the water is guided to the pool filter). (See image) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 7(d) to Section XI, Note 8(b) to Chapter 59 and by the wording of CN codes 5911, 5911 90 and 5911 90 99. Due to the elasticity and diameter of the hemmed edge the article is suitable for use in skimmer baskets of different diameters. Due to its elongated shape and flexible material the article lines the baskets completely. The densely crocheted yet porous (for efficient water filtration) textile fabric, resistant to water and chlorine, is suitable to filter dirt and debris out of the water of a swimming pool. The article consequently presents particular objective characteristics that identify the article as being for use inside skimmer baskets in order to filter dirt and debris out of the water of a swimming pool within the meaning of Note 8(b) to Chapter 59. (See also the first paragraph of the HSEN to heading 5911.) Therefore, the article is to be classified under CN code 5911 90 99 as textile products and articles, for technical uses, specified in Note 8 to Chapter 59.

    Commission Implementing Regulation (EU) 2025/1492

    Of 14 July 2025 — CELEX 32025R1492

    CN code assigned:6212 90 00

    Description of the goods

Article in the shape of a belt (approximately 25 cm wide in the middle of the back), made of highly elasticated knitted textile fabrics to be worn around the lower back (lumbar region). In the middle of the back of the belt, there is a vertical strip sewn to it. The strip is approximately 11 cm wide, consisting mainly of woven textile fabrics and not elasticated. The article is closed around the body by means of a Velcro-type closing. In order to tighten the article even more around the waist and to exert more pressure, on the outside of the article two highly elasticated bands are attached to the vertical strip on the back. The ends of these bands can be stuck to the front with Velcro attachments. On the inside in the middle of the back the article has four vertical pockets that contain strips of flexible steel (measuring approximately 22 cm (length) × 2 cm (width)). Two of these four steel strips can be removed. The steel strips can be easily bent by hand and swing back to the original position. A pressure pad in the shape of a heart (measuring approximately 16 cm (length) × 15 cm (width)) of cellular foam covered with woven textile fabrics can be attached to a vertical Velcro-type strip situated on the inside of the article in the middle of the back to exert pressure to the spine. The article is produced in five sizes depending on the circumference of the waist. (See images) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 7(d) to Section XI, Note 1(b) to Chapter 90 and by the wording of CN codes 6212 and 6212 90 00. Classification under CN code 9021 10 10 as orthopaedic appliances is excluded, because the elasticity of the belt is the sole factor which contributes to the supporting effect according to Note 1(b) to Chapter 90. The pressure pad and the flexible steel strips contribute merely insignificantly to the intended supporting effect. The pressure pad serves mainly to relieve pain and the flexible steel strips serve also to prevent the article from coiling and, thus, do not hinder the application of Note 1(b) to Chapter 90 according to the Court of Justice’s judgment of 7 November 2002, Lohmann and medi Bayreuth, Joined Cases C-260/00 to C-263/00, ECLI:EU:C:2002:637 (see paragraphs 48 and 50). Moreover, due to the elasticity of the belt and the flexibility of the steel strips which cannot even withstand a force applied manually, the belt is not able to completely, and under all circumstances, prevent undesired movements of the spine. The pressure applied to the spine only limits conscious movements but does not completely prevent specific movements of the spine in order to exclude further injuries (Note 6 to Chapter 90) as required for orthopaedic appliances of heading 9021 according to the second paragraph of Additional note 2 to Chapter 90. Therefore, the article is to be classified under CN code 6212 90 00 as other similar articles.

    Commission Implementing Regulation (EU) 2025/1220

    Of 16 June 2025 — CELEX 32025R1220

    CN code assigned:2106 90 98
    In force

    Description of the goods

The product is a mixture in the form of a powder consisting by weight of the following: — 60-80 % of sucrose (sugar); — 20-40 % of gellan gum (a natural polymer). The sucrose standardises the thickening and stabilising properties of the gellan gum. However, it also acts as an anti-caking agent and prevents clumping during application. The product is intended for use at approximately 0,1 % by weight as a stabiliser and thickener in soya-based beverages.

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 1(b) to Chapter 38 and the wording of CN codes 2106, 2106 90 and 2106 90 98. The significant addition of sucrose goes beyond mere standardisation of the properties of the gellan gum and serves to facilitate the use of the product in soya-based beverages. Consequently, the product is particularly suitable for specific use in food products rather than general use. The classification of the product in heading 3913 is therefore excluded (see the Harmonised System Explanatory Note to heading 3913, item (1), penultimate paragraph). The product is predominantly based on sucrose, a substance with nutritive value, and is of a kind used in the preparation of human foodstuffs. The product is therefore excluded from Chapter 38 by the application of Note 1(b) to that Chapter. Consequently, the product is to be classified under CN code 2106 90 98 as other food preparation, not elsewhere specified or included.

    Description of the goods

A carbonated dark red alcoholic beverage with blackcurrant flavour and aroma, containing 14,5 % of alcohol by volume. It is produced by mixing an alcoholic liquid with a carbonated non-alcoholic liquid in proportions by volume of approximately 76 % and 24 %, respectively. The alcoholic liquid is made by mixing fermented apple juice with rectified ethyl alcohol, glucose-fructose syrup, citric acid, and water. It has a strong alcoholic smell and taste and lacks the smell and taste of a fermented beverage produced from apple juice The carbonated non-alcoholic liquid contains water, glucose-fructose syrup, carbon dioxide, citric acid, blackcurrant flavouring, preservatives, and colourants (E122, E151). The fermented alcohol component in the product accounts for 54 % and the rectified alcohol accounts for 46 % of the total alcohol content. The final product has the smell and taste of blackcurrant and is intended for direct consumption. It is put up for retail sale as a blackcurrant flavoured alcoholic beverage in 0,5 l plastic bottles.

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and the wording of CN codes 2208, 2208 90 and 2208 90 69. The alcoholic liquid used in the final product lacks the taste and smell of a beverage produced from a particular fruit or natural product, and thus does not retain the character of a product falling in heading 2206. Therefore, the final product cannot be classified as a fermented beverage or as a mixture of a fermented beverage and a non-alcoholic beverage under heading 2206 (see also the Harmonized System Explanatory Notes to heading 2206, third paragraph, and the Combined Nomenclature Explanatory Notes to heading 2206 00). Consequently, the product is to be classified under CN code 2208 90 69 as other spiritous beverage in containers holding 2 litres or less.

    Commission Implementing Regulation (EU) 2024/3133

    Of 9 December 2024 — CELEX 32024R3133

    Description of the goods

A rectangular article, measuring approximately 185 cm × 132 cm, made up of a thick, densely woven, single coloured textile fabric of man-made fibres (100 % polyester) having the shape of a shell (which is designed to be filled) for a rectangular giant cushion (so-called beanbag). The article has wide hemmed edges along its sides. Four metal eyelets are attached to the four corners of the hemmed edges and another two metal eyelets are attached each to one of the two longer hemmed sides (approximately one quarter of the length of the side measured from the corner). The article has a zip opening to allow for filling. Two adjustable straps made of the same textile fabric as the main article and having a snap hook attached to each side are presented together with the article. The straps are designed to be fixed to the metal eyelets by means of their snap hooks, in order to raise part of the cushion. (See image of a filled shell) (*)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature (GIR), Note 7 (f) to Section XI and by the wording of CN codes 6307, 6307 90 and 6307 90 98. Once the article is filled, due to its objective characteristics, it is similar to cushions. It is designed like a giant rectangular cushion and not as a seat of heading 9401 due to its instability (which makes it yield to the body weight and collapse when a user is leaning into it). Therefore, the filled article would be classified under CN code 9404 90 90 as articles of bedding and similar furnishing (for example, cushions, pouffes and pillows) by the application of GIR 1 and 6. However, classification of the unfilled, unfinished article under heading 9404 as articles of bedding and similar furnishing is excluded, because the article does not have the essential character of a complete article of heading 9404 within the meaning of GIR 2 (a). It is not yet stuffed or internally fitted with any material. Given that the article is a shell for a giant cushion, classification under heading 6302 as bed linen is excluded, because the article does not have the objective characteristics and properties of bed linen of heading 6302. It is not covering a pillow or cushion like bed linen is. (See Commission Implementing Regulation (EU) 2024/966 (OJ L, 2024/966, 27.3.2024, ELI: http://data.europa.eu/eli/reg_impl/2024/966/oj). Given that the article cannot be classified in a heading that is more specific than heading 6307, it is therefore to be classified under CN code 6307 90 98 as other made-up article of textile fabrics.

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 3926, 3926 90 and 3926 90 97. Although the pipette tips are suitable for use solely or principally with the pipetting apparatus and automated dosing systems of heading 8479 and they are significantly involved in the absorption and precise dosing of the liquid, they cannot be considered as parts of these apparatuses, as they are interchangeable and disposable components. Moreover, while a pipetting apparatus or automated dosing system cannot carry out its function without the pipette tips, it is nevertheless established that the mechanical and electrical functioning of those machines is not dependent on the pipette tips. Consequently, classification under heading 8479, as parts of the pipetting apparatus is excluded. (See also judgment of the Court of Justice of the European Union of 19 July 2012 in Case C-336/11, Rohm & Haas Electronic Materials CMP Europe GmbH and Others, ECLI:EU:C:2012:500, paragraphs 35-39.) Due to their objective characteristics, the products are to be classified according to their constituent material, under heading 3926, as articles of plastics. The products are therefore to be classified under CN code 3926 90 97, as other articles of plastics.

    Description of the goods

A so-called projector with tuner in a single housing measuring approximately 53 × 13 × 34 cm, consisting of a digital light processing (DLP) laser technology projector and a built-in television tuner. The product has the following main features and interfaces: — wireless connectivity via Bluetooth and Wi-Fi, — smart TV and built-in intelligent assistants (for example, Google Assistant, Bixby, Alexa), — Internet of Things (IoT) compatible, — digital and analog TV tuners, — 4K resolution (3840 × 2160 pixels), — built-in speakers with 2.2 channel surround, — 3 HDMI ports, — USB port, — digital audio output, — Ethernet (LAN) RJ-45 port, — antenna. The product is capable of receiving television signals through the built-in television tuner and video signals through a computer or a smartphone. It can, subsequently, reproduce such signals as projection images. It is designed to display video and still images on an external projection screen (not incorporated and not presented with the projector) or on a wall. (See images) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, and by the wording of CN codes 8528, 8528 72 and 8528 72 10. The projector incorporates a television tuner; therefore, it is considered to be a reception apparatus for television. (See also the Harmonized System Explanatory Notes (HSEN) to heading 8528, third paragraph). Although the projector does not incorporate a monitor or a screen, it is considered a video display device, as it contains the DLP display technology which allows the device to directly display video or still images by projecting them on an external projection screen or a on wall. Consequently, classification under subheading 8528 71 is excluded. (See also HSEN to heading 8528, point (D)). Due to its objective characteristics, the product is considered to be projection equipment incorporating reception apparatus for television. (See also Explanatory notes to the Combined Nomenclature to subheading 8528 72 10) The projector with tuner is therefore to be classified under CN code 8528 72 10, as television projection equipment.

    Description of the goods

A machine, so-called tactical response robot consisting of the following: — a track-mounted chassis with dimensions of approximately 1 500 × 1 200 × 1 300 mm, with 2 electrical 7,5 kW drive motors for propulsion, providing a tractive force of up to 4 tonnes (the electrical power is supplied by a lithium-ion battery), — a camera system with four static directional cameras, capable of transmitting a live image feed to the user, — 6 LED spotlights each aligned in the direction of movement, as well as LED ambient lighting, — a device for the dispersing of water or foam for firefighting, with a capacity of up to 2 000 l/min at 10 bars, fully compatible for connection with the hose of a firefighting truck, — a cable winch with an extendable claw support for stability when handling large loads. The product is controlled via remote control with a range of up to 150 m and/or from a system carrier vehicle via intranet with a range of up to 2 500 m (WLAN-based). The product may be presented in different configurations depending on the extra equipment mounted on the chassis, upon request. The optional equipment may include movable cameras for normal and thermal image transmission, additional LED spotlights, a Raman spectrometer for the detection of hazardous substances, a remotely controlled manipulator arm to perform precise tasks (e.g., sampling), a trailer coupler, etc. The product is designed to be used in firefighting and recovery operations, allowing the firefighting personnel to remain outside the danger zone (conditions of hazardous material exploration, collapse danger or intense heat development), while still being involved in and remotely controlling the operations at a safe distance.

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 3 to Section XVI and by the wording of CN codes 8424, 8424 89 and 8424 89 70. Although the product has a significant tractive force, classification under heading 8701 is excluded, as it is not a vehicle constructed essentially for hauling or pushing another vehicle, appliance, or load. (See also Note 2 to Chapter 87) Classification under heading 8705 is also excluded, as the product does not have the characteristics of a vehicle of heading 8705, namely it does not form what is in fact an essentially complete motor vehicle chassis or lorry (truck). It does not comprise at least the following mechanical features: propelling engine, gear box and controls for gear-changing, and steering and braking facilities. (See also Harmonized System Explanatory Notes to heading 8705.) The product is a composite machine within the meaning of Note 3 to Section XVI and it is to be classified as if consisting only of that component or as being that machine which performs the principal function. Due to the objective characteristics of the dispersing device, mainly the volume, the pressure and the projecting distance of the water or foam, the dispersing function is considered to be the principal function of the machine. The product is, consequently, to be classified according to the dispersing device. The camera system and the LED spotlights serve to remotely control and guide the machine, whereas the winch operation for transferring loads is only performed by human intervention via the cable winch and, optionally, via the trailer coupler. The functions of identifying possible dangerous fields, detecting hazardous substances and performing precise tasks, are complementary and subsidiary to the function of dispersing water or foam, as they are performed by the optional equipment. The product is therefore to be classified under CN code 8424 89 70, as other appliances for the dispersing of fluids.

    Description of the goods

A tight fitting, highly elastic unisex panty made of a circular knitted, thin textile fabric of man-made fibres (96 % polyester and 4 % elastane). The main part of the panty is knitted as a seamless tube. At the base of the product, there is a seam which closes the opening along one leg via the crotch to the bottom of the other leg. The panty does not contain a gusset within the crotch area of the product. The panty has a broad, tight and highly elasticated ribbed waistband. The ends of the short panty legs are hemmed. The hemmed part is highly elasticated and the legs are tight fitting. The panty is suitable for washing. At importation the panty is declared to be part of a two-piece ‘incontinence management system’ (panty and incontinence pads). Due to its elasticity, the panty is suitable for fixing various articles to the skin of the wearer, for example various pads (of different sizes and shapes) or wound dressings. There is no indication in the design of the panty whether it is made to hold pads or wound dressings. Neither napkin liners nor absorbent pads nor any sort of wound dressings are imported together with the fixation panties. (See images) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 1 and 9 to Chapter 61 and by the wording of CN codes 6108 and 6108 22 00. Classification under heading 9619 is excluded. The panty as such is not an article similar to any of the articles covered by heading 9619, because it is merely a tight fitting highly elastic unisex panty of thin textile fabrics. Contrary to all other articles enumerated under that heading, the panty itself does not have any special absorbent features to qualify, for example, as a napkin (diaper). Its material does not prevent the leakage of bodily fluids and does not wick fluids from the body (see also the Harmonized System Explanatory Notes to heading 9619, first paragraph, and Additional Note 1 to Chapter 96 of the Combined Nomenclature, where the absorbing characteristics of those articles is stressed). Moreover, classification under CN code 9619 00 89 as incontinence care articles is excluded. The article cannot be considered as an incomplete or unfinished, unassembled (the missing absorbing part would be added after importation) article within the meaning of GIR 2(a). The panty does not have the essential character of an incontinence care article, since it cannot be concluded from the design of the panty whether it is meant to serve for wound dressing or for incontinence, or for any other purpose that requires the fixation of products to the skin of the wearer. Consequently, the elastic textile panty without any fluid absorbing features is not an article of heading 9619. The panty is, however, similar to the unisex knitted brief classified under heading 6108 in point 3 of the Annex to Commission Regulation (EEC) No 350/93 (1), where the cut and the considerable elasticity of the classified knitted unisex brief permits, for example, a pad to be positioned in it and which, in that case, would be suitable for, for example, incontinence. The absence of a gusset in the panty does not exclude it from classification under heading 6108. The unisex article is therefore to be classified under CN code 6108 22 00 as women’s or girls’ panties.

    Description of the goods

The product is a liquid mixture of chemicals consisting by weight of the following: — 63 % of tetrahydro-1,1,2,3,3-pentamethylindane (THPMI; CAS RN 33704-59-5); and — 34 % of hexahydro-1,1,2,3,3-pentamethylindane (HHPMI; CAS RN 33704-60-8); and — 3 % of 1,1,2,3,3-pentamethylindane (PMI; CAS RN 1203-17-4). The mixture is obtained by catalytic hydrogenation of PMI (starting material). The products formed during the chemical reaction are THPMI (main product) and HHPMI (by-product). The mixture is intended for direct use, without any purification, in the production of (rac)-6,7-Dihydro-1,1,2,3,3-pentamethyl-4(5H)-indanone (DPMI; CAS RN 33704-61-9) through allylic oxidation of THPMI.

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 1(a) to Chapter 29 and the wording of CN codes 3824, 3824 99 and 3824 99 92. Due to the significant concentration of HHPMI, the product is a mixture that cannot be considered as a separate chemically defined organic compound consisting of one molecular species within the meaning of Note 1(a) to Chapter 29 (see the Harmonized System Explanatory Notes to Chapter 29, General, point (A), first paragraph). The mixture is therefore excluded from classification in Chapter 29. Consequently, the mixture is to be classified under CN code 3824 99 92 as other preparations of the chemical or allied industries, not elsewhere specified or included.

    Description of the goods

    1. Tight fitting garment covering the upper part of the body, made of three different kinds of knitted textile fabric of man-made fibres. It consists of a main fabric and several panels attached to the main fabric: — the main fabric (85 % polyester and 15 % elastane) (single jersey plain knit fabric), and — the firm panels (100 % polyester) (interlock knit fabric), and — the mesh panels (92 % polyester and 8 % elastane) (warp knit fabric). The garment has a round neckline, short close-fitting sleeves and on the back it is hemmed along the bottom incorporating a relatively firm elastic band of a width of approximately 2,5 cm. The front of the garment has two horizontal firm panels that are attached to the main fabric in the lower quarter of the garment. The widths of these panels correspond with the length of the hook-and-eye closing system. The back is made of a firm panel extending vertically along the spine and branching left and right over the shoulders, flanked by vertical mesh panels and the main fabric. The garment has a full front opening that is closed with a zip and in addition at the lower quarter of the opening there is a hook-and-eye closing system underneath the zip. The design of the garment contributes to straightening the back by supporting an upright posture of the wearer. (See images under 1) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 2(a) to Chapter 61, Note 1 to Chapter 62, Note 1(b) to Chapter 90 and by the wording of CN codes 6212 and 6212 90 00. Classification under heading 9021 as an orthopaedic appliance is excluded within the meaning of Note 1(b) to Chapter 90, because this garment is a supporting article of textile material whose effect on the organ to be supported (for example, the straightening of the back) derives solely from the elasticity of the article. The different elasticities of the different panels (even the firm panels have a certain amount of elasticity, since they are knitted) create the body-supporting effect. Classification under CN code 6106 20 00 as women’s or girls’ blouses, shirts, shirt-blouses and under CN code 6109 90 20 as T-shirts, singlets and other vests is excluded, because the article primarily has the characteristics of body-supporting garments (the double closing system consisting of a zip and a hook-and-eye closing, the effects due to the combination of the firm knitted panel along the spine and over the shoulders with the more elastic panels and the tension on the posture of the wearer created by the different elasticities). The garment is designed to contribute to the straightening of the back by supporting an upright posture of the wearer. Consequently, the article is designed as body-supporting garment (see the Harmonized System Explanatory Notes to heading 6212) and, therefore, excluded from Chapter 61 within the meaning of Note 2(a) to that Chapter. The article is therefore to be classified under CN code 6212 90 00 as similar articles.

    Description of the goods

    2. Tight fitting garment covering the upper part of the body, made of two different kinds of knitted textile fabric of man-made fibres: the front of the garment is made of a pile fabric (sort of terry fabric; 83 % polyester, 17 % elastane) and the back of the garment is made of mesh fabric (100 % nylon). The garment has a round neckline. It is sleeveless and has a full front opening that is closed with a zip. In addition, at the lower half of the opening there is a hook-and-eye closing system underneath the zip. At the lower third of the front panels there is a double layer of textile fabric (the second layer of textile fabric is sewn on to the inside). On each side of the garment at the bottom of the front panels an elastic band (of a width of approximately 10 cm and a length of approximately 10 cm) is sewn on. These two elastic bands serve to tighten the lower part of the garment and can be fixed and adjusted to the front panels by means of a Velcro type attachment. On the back of the garment there are three patches for Velcro type fixation attached (each patch is approximately 5 cm wide and 9 cm long). Two of those patches are situated above the shoulder blades and the third patch is situated slightly lower in the middle of the back, where the vertebral column is. Those patches allow for the attachment of two elastic bands on the outside of the garment. The two elastic bands (of 100 % polyester; approximately 8 cm wide and 45 cm long) are presented together with the garment and can be attached to the patches above the shoulders and the patch in the middle. They are intended to extend from the shoulders diagonally down the back to the side of the garment at the height of the waist, where they can be adjusted (attached as tight as needed to the front material). On the inside of the garment each of two (approximately 5 cm wide and 30 cm long) elastic bands of cellular plastics is sewn with its short side to one of the two shoulder patches. Each of these two elastic bands extends over the shoulder down to the breast of each front panel, where each band is sewn with its short side to the inside of the front panel. Those elastic bands are held in place by three textile loops fixed to the inside of each front panel of the garment. On the back of the garment a band (of cellular plastics; of a width of approximately 3,5 cm) is attached on the inside along the bottom of the garment. The design of the garment contributes to straightening the back by supporting an upright posture of the wearer. (See images under 2) (*1)

The adjustable, elastic bands create the body-supporting effect. Classification under CN code 6109 90 20 as T-shirts, singlets and other vests or under CN code 6110 30 99 as women’s or girls’ waistcoats or similar articles is also excluded, because the article has primarily the characteristics of body-supporting garments (the double closing system consisting of zip and a hook-and-eye closing, the effects due to the tension on the back of the wearer created by the two adjustable elastic bands that extend diagonally from the shoulders down to the waist, and the tension on the back exerted by the elastic bands on the inside of the garment).

Article in the form of a presentation catalogue measuring approximately 22 × 25 cm, consisting of solid, glossy paperboard, printed in colour with information on the hair dye advertised in it. The inner pages of the catalogue are mainly unprinted and contain samples of synthetic fibre hair strands (approximately 4 cm long and approximately 2 cm wide) arranged by shade of colour which are inserted by gluing or are attached with detachable plastic clips. The article is designed for advertising, presenting and illustrating (to make a choice) the different hair dye colours in direct sales, hair dressing salons or exhibition/presentation stands. (See image) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the combined nomenclature, Note 5 to Chapter 49 and the wording of CN codes 4911, 4911 10 and 4911 10 90. The article is essentially devoted to advertising and promoting different shades of hair dyes. In accordance with Note 5 to Chapter 49, brochures and trade catalogues are to be classified in heading 4911. The article is an advertising matter of heading 4911 intended to promote and illustrate a range of hair dye colours and is not more particularly covered by any of the preceding headings of Chapter 49 (see also the Harmonized System Explanatory Notes to heading 4911, 1st and 5th paragraph, point (1)). The article is therefore to be classified under CN code 4911 10 90 as other trade advertising material and the like.

    Description of the goods

An article (so called passive optical splitter) in the form of a plastic box with dimensions of approximately 377 × 176 × 40 mm, with one input port and 32 output ports. It contains optical fibre cables, SC/APC type connectors, and in one housing an optical waveguide with a ‘splitter chip’ and a cladding made of a material with a low refractive index. The article is designed to be used in a passive optical network (PON) to split the optical signals transferred through it by optical cables. It is a passive optical element which operates without any electrical or electronic system which splits the input optical signal into 32 identical output signals. The functioning principle of the article is based on the difference in the refractive index between the core and cladding layer, which corresponds to the PLC (Planar Lightwave Circuit) technology. (See images) (*1)

    Reasons

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature, Note 1(m) to Section XVI and by the wording of CN codes 9013, 9013 80 and 9013 80 40. Classification in heading 8517 as other apparatus for the transmission or reception of voice, images or other data, including apparatus for communication in a wired or wireless network, is excluded, as the article is designed to merely split the optical signals transferred through it by optical cables. Neither modulation or transmission, nor reception or conversion within the meaning of heading 8517, is performed. As the article contains a waveguide, the presence of which is not allowed in the scope of heading 8544, classification as optical fibre cables, made up of individually sheathed fibres, whether or not assembled with electric conductors or fitted with connectors is also excluded (see also HSEN to heading 8544, 8th paragraph). Consequently, the article is considered to be an optical device within the scope of Chapter 90. Therefore, the article is to be classified under CN code 9013 80 40 as passive optical splitters, not containing any electrical or electronic elements, for telecommunications.
